• Any failure by purchaser to follow the instructions or procedures for transport, storage, cleaning,
maintenance, or use of the product, detailed in this manual or any subsequent documentation provided by
Umano Medical, that directly or indirectly caused the defect or damage to the product.
• Damage caused to the product, or any parts, by misuse, abuse, or neglect by the purchaser or a third party,
including any caregiver or patient.
• Damage caused to the product by abnormal use in a medical setting, including by needle puncutres, burns,
chemical products, and liquid stains.
• Damage or product failure due to causes beyond Umano Medical's control, including natural causes (such
as fire, flood, wind, lightning, freezing), acts of God, accidents, theft, loss, unusual atmospheric conditions,
or material degradation due to moisture exposure.
• Purchaser's failure to provide proof of purchase of the product to Umano Medical.
• Any damages caused to the product during transport or transfer of patient.
• Any product that no longer has its original labelling, serial number, or other identification marks, by removal,
destruction or alteration.
What is provided in the Documentation and hereinabove is the sole warranty of Umano Medical in connection
with the product, to the extent not contrary to any minimum requirement under applicable law. All other warranties
and conditions (expressed, implied, statutory or otherwise) are hereby excluded, including in respect of (a) the
merchantability or otherwise of the product; (b) the fitness or otherwise of the product for any specific purposes;
or (c) the performance, non-performance, failure, efficacy, length of life of, or any defect in the product, or in any
parts, in each case, wether or not the product was selected or used in accordance with any recommendations,
assistance or instructions of Umano Medical. Without in any way limiting the generality of the foregoing, in no
event shall Umano Medical be liable in contract, tort or otherwise for special, indirect, punitive, incidental, or
consequential damages.
