6.3.5 The manufacturer reserves the right to carry out in situ reports based on the
claims it has received, in order to verify any aspects that may be useful for better
consideration of warranty claims. For this reason, the customer must not make
any changes to the installation conditions which gave rise to the complaint
without the prior written agreement of the technical department.
6.4 Limitation of liability
6.4.1 The manufacturer is not liable to the customer, either directly or indirectly,
for any failure or delay in fulfilling warranty obligations that may result from
external pressure or other circumstances beyond the manufacturer's control.
6.4.2 The manufacturer's liability under this warranty certificate is limited to the
above obligations and to the amount corresponding to the purchase receipt of the
product to be claimed; excluded is any liability for consequential damages such
as loss of data to information applications, loss of production, thermal variations
to service, etc. which do not violate the applicable regulations of any country
regarding product liability.
6.4.3 The above warranty limitations will be applied in all cases, and where they
do not violate any country's regulations concerning product liability. If this
circumstance invalidates some of the preceding clauses, the invalidation will
relate only to that clause, while the others will remain valid. In conclusion, the
application of any regulation indicated in the present warranty that would violate
the Law
23/10 July 2003 and Directive 1999/44/EU concerning domestic hot water tanks
and their use within the EU.
6.4.4 Any other warranty claims not mentioned in this warranty certificate are
excluded, as is any liability for consequential damages such as loss of data in
computer applications, loss of production, thermal variations in service, etc. which
do not infringe the applicable product liability regulations of any country.
6.4.5 The above warranty limitations will be applied in all cases and where they
do not contravene any country's product liability regulations. If this circumstance
invalidates some of the preceding clauses, the invalidation will only concern that
clause, while the others will remain valid. In conclusion, the application of any
regulation indicated in the present warranty which violates Law 23/10 July 2003
and Directive 1999/44/EU concerning domestic hot water tanks and their use on
EU territory is excluded.
6.4.6 Any other warranty rights not mentioned in this warranty certificate are
excluded.
