11 Warranty

§ 1 Warranty scope
1. The manufacturer/warrantor provides the purchaser/
warrantee with a warranty that includes the functionality of
the components mentioned in section 2 for the period of
two years.
2. If such a component ceases to function within the warranty
period, the purchaser/warrantee is entitled to the required
professional repair by replacing or repairing the component.
The warranty does not include any claim to rescission of the
sales contract or abatement (reduction of the purchasing
price). The manufacturer repairs damage or faults of the unit
that are based on manufacturing errors free of charge, pro-
vided they are reported immediately after identification.
3. The repairs included in the warranty also comprise testing,
measuring and adjusting work, if necessary as a result or the
remedy of a damage under warranty, but not maintenance
work recommended by the manufacturer.
§ 2 Warranty extent
1. The warranty includes all assemblies and components of the
unit.
2. In order to be entitled to warranty, the fault must be reported
together with a copy of the invoice.
3. Claiming warranty does not extend the warranty period or
start a new warranty period.
4. The warranty period for built in spare parts ends with the
warranty period for the whole unit.
§ 3 Exclusion from warranty
1. The warranty expires, if persons who are not authorized by
the manufacturer/warrantor carry out repairs or open the unit
for purposes other than its intended use, or if the unit is fitted
with spare parts that are not intended for this type of unit.
2. The warranty does not include transport damage, i.e. direct
and sudden mechanical damage from outside.
3. The warranty expires if the unit is used improperly in ways not
described in the operating manual or for other purposes.
4. The warranty does not cover claims beside those mentioned
in section 1; in particular, it does not cover any damage
arising outside of the unit, as long as liability is not required by
law.

§ 4 Duties of the purchaser/warrantee
1. The purchaser must have all maintenance, calibration and
service work recommended in the operating manual/unit
carried out at the depot/seller or in a workshop authorized by
Dentsply.
2. The operating manual on the proper operation of the unit
must be read prior to the first operation.
3. The special packing must be preserved carefully. If repairs
become necessary, the unit must be packed according to the
packing instructions.
§ 5 Transferring of claims and limitation of time
1. If the unit is sold while under warranty, the warranty claims
are transferred to the new owner together with the ownership
of the unit.
2. A warranty claim becomes prescribed 6 months after the
damage occurred, and at the latest 6 months after the end of
the duration of warranty.
§ 6 Consequences of a breach of duty
If the purchaser/warrantee breaches one of the duties described
in section 4 cl. 1 and 2, the manufacturer/warrantor is freed from
their duty to provide warranty in this case.
§ 7 Legal liability
Legal liability remains unaffected by this warranty. This warranty
exists beside the legally required warranty. If breaching the duty
from section 4 cl. 3, the warranty expires, if the purchaser can-
not prove that the breach of duty did not cause any damage.
§ 8 Applicable law
This warranty is subject to German law.
Exclusive court of jurisdiction is Hanau am Main.
