If SOLARMAX is unable to repair or replace the equipment during the warranty exten-
sion period, SOLARMAX shall reimburse the customer for the costs of the warranty
extension. This reimbursement shall amount to 100% of the gross purchase price of
the warranty extension paid by the customer as stipulated on the purchase receipt or
comparable proof.
In the case of storage systems, SOLARMAX guarantees that the storage module / accu-
mulator can be operated with a usable capacity of 70% of the nominal capacity during
the warranty extension period.
In the case of storage systems, the warranty holder must pay excess to the warranty
provider for each warranty claim during the optional warranty extension. In the event
of a defect of the device, excess for the costs of the material services up to a maximum
amount of € 250.- (net, i.e., plus statutory value-added tax) per warranty claim must
be paid to the warranty provider. In the event that a storage module / accumulator is
defective, the warranty holder shall pay the warranty provider an excess of €250/kWh
(net, i.e., plus statutory value-added tax) of the nominal capacity of the storage module
/ accumulator at the start of the service life, for the costs of the material services.
9.4 Conclusion of the warranty extension
In order to purchase a warranty extension, a fully completed warranty extension form
must be submitted. The optional warranty extension shall only be validly concluded
upon written confirmation by SOLARMAX, receipt of the warranty certificate and pay-
ment by the customer. The current SOLARMAX price list shall apply to the prices of the
warranty extensions.
Deviating written commitments by SOLARMAX shall take precedence.
10� Conditions after expiry of the BASIC warranty or after expiry of the optional
warranty extension
The costs for repair and replacement after the expiry of the warranty period shall be
charged according to the expenditure and the repair cost rates, as well as the service
flat rates valid at that time. SOLARMAX shall ensure repair and replacement capability
beyond the warranty period at its own discretion.
11� Applicable law, place of jurisdiction
The law of the Federal Republic of Germany shall apply. The exclusive place of jurisdic-
tion shall be Augsburg/Germany, insofar as this is legally permissible.
12� Final provisions
12.1 The warranty shall apply independently of the seller's liability for defects
(SOLARMAX or its specialist trade partner) arising from the purchase contract with
the warranty holder and shall not affect it. The BASIC warranty does not limit possible
claims against SOLARMAX as manufacturer under the Product Liability Act.
12.2 If a customer resells a SOLARMAX device, this warranty shall pass from the pre-
vious to the new owner of the SOLARMAX device to the extent of the remaining war-
ranty period upon signing of the purchase contract. The respective new owner is then
deemed to be the new warranty holder within the meaning of these Warranty Condi-
tions. In this case, the warranty to the original warranty holder shall expire.
