within 4 weeks after receipt of the invoice. The repair shall be carried out after receipt
of full payment.
If the customer rejects the repair offer, or if the repair has already been carried out wit-
hout a prior repair offer, SOLARMAX shall be entitled to charge a lump sum of € 165.00
(net, i.e., plus statutory value-added tax) for the diagnostic services rendered, as well
as the service and transport costs incurred in the amount of € 0.60 (net, i.e., plus statu-
tory value-added tax) per kilometre actually driven, plus the hourly rate of the service
provider commissioned by the warranty provider and the materials used.
SOLARMAX shall only be entitled to charge for costs incurred if the customer has cul-
pably failed to establish that there is no defect triggering the warranty claim and/or no
claim exists under this warranty promise resulting from the circumstances listed under
section 7.
7.
Exclusion of warranty services
A warranty claim shall not exist in the following cases in particular:
in the event of transport damage or external influences

in the event of interventions, modifications or repairs carried out by the warranty
●
holder itself or by personnel not authorised by SOLARMAX
in the event of improper use, incorrect operation or installation contrary to the
●
installation or operating instructions
if a copy of the invoice for the purchase of the device is not presented
●
if the seal affixed by SOLARMAX or the type plate is removed, damaged or
●
destroyed, or if the type plate on the device is illegible
if the operating, installation and maintenance instructions are not observed
●
in the event of operation under ambient conditions that do not comply with
●
those specified in the device documentation (e.g., insufficient ventilation, air
humidity, dust load, temperature, etc.)
in the event of force majeure (e.g., lightning strike, overvoltage, water damage,
●
fire, etc.)
the warranty does not cover wearing parts, in particular fuses, overvoltage
●
protection devices and fans
for storage systems, if the device has not been kept under constant remote
●
monitoring and control by SOLARMAX via the SOLARMAX Internet portal with
permanent Internet connection
for storage systems, if a completed and signed commissioning report in
●
accordance with the SOLARMAX model has not been sent to SOLARMAX within
two weeks of the installation of the device
if operated with a power source other than a photovoltaic system
●
if operated with storage modules or accumulators other than those approved by
●
SOLARMAX
if spare parts and accessories are used that do not comply with SOLARMAX
●
specifications
in the event of pest infestation or other damage caused by animals
●
in the event of an interruption in the power supply, provided that the customer is
●
responsible for the interruption and that it is not caused by a hardware and/or
software fault in the SOLARMAX device
