maintenance and to adjust the system and battery performance or battery discharge
depth to optimise battery service life by means of remote maintenance and control.
SOLARMAX is constantly striving to improve its products and the software used. To
this end, updates are developed and made available to the customer in order to, among
other things, eliminate software errors that have occurred, adapt interfaces to other
products and systems and make improvements to the software or the system, as well
as system integration within the scope of the existing BASIC warranty. If the customer
refuses this, the warranty services shall lapse in accordance with the Warranty Condi-
tions stated herein.
Utilisation of public support programmes
If the warranty holder makes use of a public support programme, the warranty holder
maybe required to pay the current value of the memory module in case of a warranty
claim, instead of a repair or replacement of a defective memory module in accordance
with the Warranty Conditions. The initial fair value of the memory module shall be the
net value of the memory module at delivery and shall be depreciated on a straight-line
basis over a period of 10 years.
4.2 Any claims against SOLARMAX beyond the scope of this warranty promise, in
particular for compensation for direct or indirect damage caused by the defect of the
SOLARMAX device or installation and removal costs or lost profit, compensation for
use, as well as lost electricity/heating/mobility cost savings are not substantiated by
the BASIC warranty and are therefore expressly excluded to the extent permitted by
law.

Repair and replacement guarantee
5.1 During the warranty period, SOLARMAX shall keep repair materials and replace-
ment equipment available at its discretion. In the event that repair materials or repla-
cement units are no longer available for certain devices, the following shall apply:
5.2 SOLARMAX shall be authorised to substitute the device to be replaced with a
comparable device of equal or higher performance. The BASIC warranty shall cover
any technical adjustments required in the replacement unit for the installation of such
replacement unit up to an amount equal to 10% of the list price of the replacement unit
for time and material expenditure. The BASIC warranty does not cover the replacement
and connection of peripheral equipment, if required, or other necessary adjustments
to the equipment's environmental facilities (such as power cables, ventilation and
safety equipment). However, SOLARMAX will endeavour to minimise the extent of any
adjustments required. If repair material is no longer available at reasonable expense,
SOLARMAX shall be authorised to replace the defective device. In this case, the afore-
mentioned provisions on replacement in accordance with section 4 shall apply, inclu-
ding the provisions on service and transport.

Costs in the event of unjustified warranty claims
If the customer makes a claim against SOLARMAX because of a defect and it is found
during the inspection of the SOLARMAX equipment that there is no defect justifying
the warranty claim and/or that there is no claim under this BASIC warranty due to the
circumstances specified in the warranty provisions, SOLARMAX shall submit a cost esti-
mate to the customer with a repair quotation, which the warranty holder may accept or
reject.
If the customer accepts the cost estimate and the repair offer, SOLARMAX shall issue
an invoice for the costs listed in the cost estimate, which is payable by the customer
