The above warranty provisions apply exclusively and in place
of all other contractual and statutory warranty obligations, in-
cluding but not limited to, the legal warranty of marketability,
fitness for purpose and serviceability.
The manufacturer accepts no liability for any direct or indirect
consequential damage, irrespective of whether caused by law-
ful, unlawful or other actions.
No liability is accepted under warranty for personal injury and
damage to property where claims are based on one or several of
the following causes:
•
Use of the BEMER complete system not in accordance with
intended purpose.
•
Improper start up procedures, operation and servicing
of the BEMER complete system.
•
Failure to comply with notes / warnings contained in the
operating instructions.
•
Unauthorized modifications of the BEMER complete system.
•
Failure to observe the operating instructions.
•
Improper repairs and the use of spare parts or accessories not
recommended by the manufacturer.
•
Catastrophes and force majeure.
A claim under the warranty can only be considered if the
warranty form enclosed has been completed correctly and
returned to the manufacturer.
