Lorsque les produits Fireye sont associés à des équipements fabriqués par d'autres et/ou intégrés dans
des systèmes conçus ou fabriqués par d'autres, la garantie Fireye, telle qu'énoncée dans ses Conditions
générales de vente, s'applique uniquement aux produits Fireye et non à tout autre équipement ou au
système combiné ou à ses performances globales.
GARANTIES, RECOURS EXCLUSIFS ET LIMITATION DES DOMMAGES
Fireye garantit pendant un an à compter de la date d'installation ou 18 mois à compter de la date de
fabrication, selon la première éventualité, le remplacement ou, à sa discrétion, la réparation de tout
produit ou partie de celui-ci que Fireye, à sa seule discrétion, juge défectueux. Dans les matériaux ou
la fabrication ou qui n'est pas conforme à la description du produit au recto de son bon de commande.
Les obligations de Fireye en vertu de cette garantie ne s'étendent pas aux produits ou pièces de ceux-
ci que Fireye détermine avoir été installés, utilisés, entretenus, réparés ou modifiés de manière
incorrecte ou non conforme aux instructions applicables de Fireye, ou qui ont fait l'objet d'une mauvaise
utilisation, accident ou négligence.
CE QUI PRÉCÈDE REMPLACE TOUTES LES AUTRES GARANTIES, EXPRESSES ET IMPLICITES, Y COMPRIS LES
GARANTIES DE QUALITÉ MARCHANDE ET D'ADÉQUATION À UN USAGE PARTICULIER. SAUF INDICATION
SPÉCIFIQUE DANS LES PRÉSENTES CONDITIONS GÉNÉRALES DE VENTE, LES RECOURS CONCERNANT TOUT
PRODUIT OU PIÈCE FABRIQUÉ OU VENDU PAR FIREYE, OU CONCERNANT TOUTE VIOLATION OU DÉFAUT EN
VERTU DE CE CONTRAT (Y COMPRIS TOUTE RUPTURE DE GARANTIE), SERONT LIMITÉS EXCLUSIVEMENT AU
DROIT AU REMPLACEMENT OU À LA RÉPARATION FOB FIREYE EMPLACEMENT DE L'ENTREPÔT PRINCIPAL,
COMME INDIQUÉ CI-DESSUS. EN AUCUN CAS FIREYE NE POURRA ÊTRE TENU RESPONSABLE DES DOMMAGES
INDIRECTS OU SPÉCIAUX DE TOUTE NATURE QUI POURRAIENT SURVENIR EN RELATION AVEC UN TEL PRODUIT
OU UNE PIÈCE OU TOUTE VIOLATION OU DÉFAUT EN VERTU DE CE CONTRAT. DANS LA MESURE AUTORISÉE
PAR LA LOI, LA RESPONSABILITÉ GLOBALE DE FIREYE EN VERTU DES PRÉSENTES, QU'ELLE SOIT
CONTRACTUELLE, DÉLICTUELLE (Y COMPRIS LA NÉGLIGENCE) OU AUTRE, SERA LIMITÉE À UNE FOIS LA VALEUR
DU CONTRAT, À CONDITION TOUTEFOIS QUE LA LIMITATION PRÉCÉDENTE NE LIMITE PAS LA RESPONSABILITÉ
DE FIREYE POUR TOUTE BLESSURE. À, OU À LA MORT D'UNE PERSONNE, CAUSÉE PAR LA NÉGLIGENCE GRAVE
DE FIREYE.
